Charge against Adam Capay stayed

A stay of proceedings has been granted in the matter of the first-degree murder charge laid against Adam Capay, a Lac Seul First Nation band member.

On Jan. 28, in a Thunder Bay courthouse, Justice John Fregeau of the Superior Court of Justice (Ontario) issued the stay of proceedings under section 24 (1) of the Canadian Charter of Rights and Freedoms “as a remedy of his charter rights under ss 7, 9, 12 and 15 of the Charter.”

A publication ban covering the case, including evidence and reasons for this decision, remains in effect until February 27, which is the expiration date of the appeal period for this decision. 

Capay spent approximately four years in segregation in jail, in Thunder Bay, awaiting trial for his alleged involvement in the death of another inmate. 

Capay was released that day.
